Loophole to write off credit debt 'difficult to prove'

Borrowers have been warned against relying on a legal loophole to have their credit card debt written off.

The Daily Mail investigated after claims-handling firms said debts could be written off.

Lawyer Ingrid Gubbay of Cohen Milstein Hausfeld & Toll told the paper that such firms were relying on a loophole, but said they were "very difficult to prove".

The newspaper made a report after one Manchester claims-handling company, Cartel Client review, said outstanding balances could be written off for cards taken out before April 2007.

But it would not tell the Mail the legal case for its claim, saying it did not want to alert competitors and does not fully explain how it checks credit cards to see if a balance can be cleared.

St Albans was recently found to be one of the worst areas for credit card debt.

The St Albans Observer reported a study by credit reference agency Experian, which found people in the area had an average credit card debt of £1,871.
