Citizens Advice: Close tribunal loophole

A loophole that causes people who win employment tribunals to lose out on their money must be closed, Citizens Advice has said.

In its Justice Denied report, Citizens Advice said that some employers take advantage of the fact that employment tribunals cannot enforce the awards they make.

Up to 1,500 people a year are not receiving their money when the employer refuses to pay.

Most claimants denied their cash are, or were, in low paid and low skilled jobs such as retail, kitchen or catering assistants, cleaners, waiting staff or care workers.

At least ten per cent are migrant workers.

Citizens Advice noted that to chase unpaid money, people must go through a "bewilderingly complex and costly" legal process and many feel unable.

A registered charity, Citizens Advice offers free advice and information at over 3,200 places nationally.

Most of its advisers are trained volunteers and over 5.5 million problems are brought to it every year.
